Rights and Obligations of Applicants. Requirements and Procedure for the Use of the Name of the Certification Body, the Conformity Mark, and References to Issued Certificates
1. General Provisions
- This document establishes the rights and obligations of applicants (customers), as well as the requirements, restrictions, and rules for the use of the name of the Certification Body (CB), the conformity mark, and the procedure for referencing issued certification documents.
- This document is mandatory for all applicants entering into contracts with the CB and obtaining conformity assessment documents.
2. Rights of the Applicant
- To receive complete and reliable information on certification procedures, timelines, costs, and requirements.
- To submit comments and proposals regarding the activities of the CB.
- To appeal decisions of the CB in accordance with the established procedure.
- To receive copies of issued certification documents.
- To use issued conformity assessment documents within the framework of applicable legislation.
3. Obligations of the Applicant
- To provide the CB with accurate and complete information necessary for carrying out certification activities.
- To comply with the requirements of regulatory documents and the rules of the CB.
- To promptly inform the CB of any changes affecting product certification.
- To comply with the rules for the use of the conformity mark and the name of the CB.
- To cease the use of the conformity mark and any references to the certificate upon expiration, suspension, or withdrawal of the certificate.
4. Requirements for the Use of the Name of the Certification Body
- The Applicant is entitled to use the name of the CB only in a correct context related to the fact of certification being carried out.
- The use of the name of the CB in a manner that may mislead consumers is prohibited.
- It is prohibited to use the name of the CB in such a way as to imply that the CB is responsible for the quality of the product.
5. Requirements for the Use of the Conformity Mark
- The conformity mark may be used by the Applicant only if a valid certificate of conformity is in place.
- The mark may be affixed to products, packaging, transport documents, and documents related to the circulation of products.
- The mark may be used only for its intended purpose and in accordance with established rules (form, size, color, proportions).
- The Applicant shall ensure correct application of the mark, preventing any distortion.
6. Restrictions and Prohibitions
- The use of the conformity mark on products that have not undergone certification is prohibited.
- The use of the conformity mark for products whose certificate has expired, been suspended, or withdrawn is prohibited.
- It is prohibited to create a false impression that the CB approves the organization’s activities or its services.
7. Procedure for Referencing Issued Certificates
- The Applicant has the right to reference the issued certificate in advertising and informational materials, provided that the information is presented correctly and truthfully.
- References to the certificate shall include the certificate number, date of issue, and scope of certification.
- It is prohibited to reference the certificate in a manner that creates the impression that the entire activity of the company is certified if the certificate applies only to specific products.
8. Sanctions for Non-Compliance with Requirements
- Issuance of a warning to the Applicant.
- Requirement to eliminate violations within a specified timeframe.
- Suspension of the issued certificate.
- Withdrawal of the certificate in cases of repeated or gross violations.
- Notification of authorized bodies about instances of improper use of the conformity mark.
9. Final Provisions
- This document enters into force upon approval by the Head of the Certification Body.
- All applicants shall be familiarized with this document prior to the commencement of certification activities.
- This document shall be published on the official website of the Certification Body.
